A new decree has arrived!

Decree no. 2024-814 of 9 July 2024 (published in the JORF on 16 July 2024) on the administrative fine for employing foreign nationals who are not authorised to work and modifying the conditions for issuing work permits applies from 1 September 2024.

What to remember?

Key points when applying for a work permit: who is affected?
Employers are no longer the only parties concerned by the conditions for issuing work permits. Clients, user companies and host companies are also affected.
In the case of an apprentice whose employer is based outside France and who is taken on by a company based in France to complete his training, it is up to the host company to apply for a work permit.
Key points concerning a work permit refusal: What are the grounds?
A work permit may be refused if the applicant has committed serious breaches of criminal law or of health and safety with regard to his employees.
It may also be refused if the recruitment project is manifestly disproportionate to the applicant's economic activity.

When should an employer apply for a work permit?

Future employers are obliged to apply for a work permit if their future employee holds or intends to apply for one of the following residence permits:

Employee;
Temporary worker;
Seasonal worker;
Student’ beyond the period authorised by their residence permit.
When is the employer exempt from applying for a work permit?
When the future employee is a national of:
A member state of the European Union;
From the European Economic Area;
Switzerland;
Monegasque;
Andorra;
From San Marino.
If they hold one of the following residence permits:
« Private and family life» residence permit;
«Residence card»;
« Talent passport »;
When they hold a «Student» residence permit, up to the limit of the time authorised by their permit.
